Regulations of the promotion „SALE up to -60%”
§ 1 General provisions
(1) These Regulations (hereinafter: "Regulations") define the terms and conditions under which the promotion called „SALE up to -60%" takes place. (hereinafter: "Promotion").
(2) The Organizer of the Promotion is SZOPEX-Dutkiewicz sp. z o.o. sp.k. with its registered office in Olsztyn (10-166) at 6 Kotański Street, entered in the register of entrepreneurs kept by the District Court in Olsztyn, VIII Commercial Department of the National Court Register under KRS number 0000724788, NIP 7390202240, REGON 510525357 (hereinafter: "Organizer").
(3) The Promotion shall take place in the Organizer's stores operated under the brand name "Sklep Biegacza", that is:
a. in the online store available at: https://berunner.com (hereinafter: "Online Store");
(4) the Participant of the Promotion may be only natural persons purchasing products for a purpose not directly related to their business or professional activity (hereinafter: "Participant").
(5) the Promotion is valid only during the following period (hereinafter: "Promotion Period"):
a. in the Online Store - from 10:00 a.m. on 01.06.2023 to 11:59 p.m. on 24.07.2023;
§ 2 Terms and Conditions of the Promotion
(1) The subject of the Promotion is the opportunity to purchase adidas products selected by the Organizer at a promotional price, with an additional discount of 10% for Partners Club members. The current list of products included in the Promotion, along with the amount of the discount, is available at: https://berunner.com/products/discount/flags=5 The Organizer is entitled to modify the list of products participating in the Promotion. The modification referred to in the preceding sentence does not constitute an amendment to the Terms and Conditions and is effective from the moment the list of products is updated.
(2) In order to participate in the Promotion:
a. in the Online Store: add selected products to the shopping cart at the promotional price, and in order to take advantage of the additional discount -10% for Partners Club members, log in to your account at https://berunner.com, enter the code, sent in e-mail, in the field indicated for this purpose, and then activate the entered discount code using the button provided for this purpose;
(3) the Promotion does not include electronic equipment in particular: watches, heart rate monitors, sports cameras) with the exception of products included in the list of products referred to in paragraph 1 above.
(4) the Promotion covers only the products indicated at: https://berunner.com/products/discount/flags=5 and marked with the promotion message.
(5) Discounts referred to in the Regulations are not exchangeable for their cash equivalent.
§ 3 Complaints related to participation in the Promotion
(1) The Participant is entitled to make a complaint related to participation in the Promotion, in the form of:
a. in writing, to the address: SZOPEX-Dutkiewicz sp. z o.o. sp.k. Complaints Department, 1r Hozjusza Street, 11-041 Olsztyn;
b. e-mail, sent to the e-mail address of Customer Service (indicated, for example, in the footer of each sub-page of the Online Store).
(2) In order to submit a complaint referred to in paragraph 1 above, it is recommended that the Participant indicate: (1) the subject of the complaint, i.e. describe the reason for filing the complaint, (2) his/her contact information, and (3) the preferred form of the Organizer's response in a durable medium (e.g. e-mail, written form). The recommendations referred to in the preceding sentence are not a condition for filing a complaint.
(3) The Organizer will respond to the complaint, on a durable medium, within 30 days of its receipt.
(4) The administrator of the personal data provided in the complaint is the Organizer, who can be contacted, inter alia, by letter (to the address indicated in § 1.1) or electronically by e-mail sent to the e-mail address of the Customer Service (indicated, for example, in the footer of each sub-page of the Online Store).
(5) The Organizer has appointed a Data Protection Supervisor who can be contacted via e-mail address: [email protected] or by phone at +48 511 793 443.
(6) The Organizer will process personal data of the Participant submitting a complaint only in connection with the complaint, i.e. in performance of the Organizer's legal obligation pursuant to Article 6 (1) (c) RODO.
(7) The personal data provided will be processed by the Organizer until the complaint is resolved, and the statute of limitations for mutual claims expires, unless generally applicable regulations require the Organizer to store personal data for a longer period of time.
(8) Provision of data is voluntary, however, necessary to consider the complaint.
(9) The participant has the right to access, rectify, delete or restrict processing of personal data, the right to object and the right to data portability. The participant also has the right to lodge a complaint regarding the processing of personal data to the President of the Office for Personal Data Protection.
(10) The personal data provided will be shared with suppliers of technical and IT solutions (including, but not limited to, hosting, communication with customers, running an online store).
§ 4 Final provisions
(1) The Rules of the Promotion are available at the following Internet address: https://sklepbiegacza.pl/content/news
(2) The Organizer reserves the right to change these Terms and Conditions (including early termination of the Promotion) for important reasons, which are: depletion of the stock of products covered by the Promotion, change of legal regulations affecting the rights or obligations of the parties under the Terms and Conditions, change of the manner of conducting the Promotion or its scope resulting from technical or organizational reasons.
(3) In the event of a change to the Terms and Conditions, the Organizer shall make available the consolidated text of the Terms and Conditions in the manner indicated in paragraph 1 above. The change of the Terms and Conditions shall be effective as of the time indicated by the Organizer and shall not affect the rights acquired by the Participants before the change.
(4) The Promotion is not a game of chance, fantasy lottery, pari-mutuel betting or promotional lottery, the outcome of which depends on the case, as referred to in the Act of 19.11.2009 on gambling games.
