Terms and Conditions for the provision of the Newsletter service
This document (hereinafter referred to as "Terms and Conditions") defines the rules for the provision of the Newsletter service by SZOPEX-Dutkiewicz limited liability limited partnership with registered office in Olsztyn (Poland) ul. Kotańskiego 6, 10-166 Olsztyn (hereinafter referred to as the "Service Provider"), registered in the Register of Entrepreneurs in the National Court Register conducted by the Olsztyn District Court, 8th Commercial Section of the National Court Register under number KRS 0000724788, PIN 7390202240, REGON 510525357.

§ 1 General provisions
The Newsletter Service may be used by: (1) an individual (2) a legal entity or (3) an organisational unit without legal personality, which is granted legal capacity by law. In order to use the Newsletter service, a natural person with limited legal capacity must obtain the consent of his or her legal representative whenever required by the general legal provisions; a legal person and an organisational unit without legal personality to which legal capacity is granted by law may act only through an authorised person. The entities referred to in the previous sentence are obliged to provide, at the request of the Service Provider, confirmation of: the consent of their legal representative or their authorisation. The person using the Newsletter service is hereinafter referred to as the "Service Recipient".
The use of the Newsletter service is possible if the necessary technical requirements are met:
Computer, smartphone or other similar device with internet access;
web browser with JavaScript and cookies enabled, e.g. Mozilla Firefox, Google Chrome, Apple Safari or Microsoft Edge (it is recommended to use the current version of the web browser);
an active email address;
active mobile phone number (if the phone number is made available for the Newsletter service).
The service recipient is obliged to use the Newsletter service in accordance with these Terms and Conditions and generally applicable legal provisions. Significant breaches of these Terms and Conditions constitute in particular:
the provision of false personal data or failure to promptly inform the Service Provider of changes to such data (if the update of personal data is required to use the Newsletter service);
providing illegal content, i.e. content that infringes the personal and other rights of third parties (prohibition of providing illegal content).
§ 2 Purpose and principles of use of the Newsletter Service
The Newsletter Service is a free service provided by the Service Provider by electronic means at the request of the Service Recipient.
The contract for the provision of the Newsletter Service is concluded for an indefinite period of time in accordance with the Terms and Conditions.
The Service Recipient has the possibility to subscribe to the Newsletter service by means of subscription forms available in the online shops operated by the Service Provider, a list of which is attached as Annex 1 to these Terms and Conditions (hereinafter: "Online Shops").
The provision of the e-mail address is required to provide the Newsletter service. The Customer may also optionally provide a mobile phone number. In this case, the Newsletter service will be provided in the form of e-mail and SMS messages.
The subject of the Newsletter service is:
to send to the electronic means of communication chosen by the Service Recipient (e-mail, optionally mobile phone), in the form of e-mail or SMS, commercial information about products, promotions, discounts, competitions and events related to the activities of the Service Provider and its partners, a list of which is available in the Online Shop. If the Service Recipient also provides his/her name when registering for the Service, the commercial information sent is personalised accordingly based on the data provided;
sending to the Service Recipient's chosen means of electronic communication (e-mail, optionally mobile phone), in the form of e-mail messages or SMS, additional commercial information (irrespective of the information indicated in point a of this paragraph) containing personalised offers or discounts tailored to the Service Recipient's interests and preferences, but which do not significantly influence the Service Recipient's decisions (based on the personal data made available in the Online Shop, in particular through the Service Recipient's use of other services provided by the Service Provider electronically (in particular the Account).
Subscribing to the Newsletter service within the selected Online Shop results in receiving the commercial information mentioned in section 5 above, predominantly related to the selected Online Shop, as well as general news about the Service Provider and partners. In order to receive commercial information regarding the other Online Shops, to the same extent, separate subscriptions to this service must be made on the websites indicated in Annex 1. Users of the "Account" service, available within each Online Store on the basis of the principles indicated in the Online Store Terms and Conditions, can manage news subscriptions directly.
In order to conclude the contract for the provision of Newsletter services, the following steps must be completed:
provide at least one e-mail address in the appropriate field of the Newsletter service registration form, accept the Terms and Conditions and click on the "subscribe" button.
b. confirm the intention to use the Newsletter service by clicking the "confirm subscription" button in the e-mail message sent by the Service Provider to the e-mail address provided by the Service Recipient.
The conclusion of the contract for the provision of the Newsletter service takes place when the Service Recipient clicks on the "Confirm Subscription" button in accordance with section. 7 point b above.
The Service Recipient may at any time (without giving any reason or incurring any costs) opt out of receiving the Newsletter (termination of the Newsletter service contract). For this purpose, the Service Recipient may: (1) use the unsubscribe link included in each e-mail message received as part of the Service provided, (2) send an e-mail message with the opt-out information to the Service Provider's address indicated in the preamble to the Terms and Conditions, or (3) use the Newsletter functionality within the Account service. Upon termination, the contract for the provision of the Newsletter service expires.
The Service Provider may terminate the contract for the provision of the Newsletter service at any time with 14 days notice for important reasons, for example:
a. changes in the applicable provisions of general law which result in a change in the mutual rights and obligations of the parties to the Newsletter service provision contract;
b. termination of the provision of the Newsletter Service by the Service Provider.
The Service Provider may terminate the contract for the provision of the Newsletter service at any time, with a notice period of 7 days, for important reasons, for example, in the event of a major breach of the provisions of the Terms and Conditions by the Service Recipient (in accordance with § 1 paragraph 3 above).
The Service Provider shall send statements of termination of the contract for the provision of the Newsletter service pursuant to §§ 10 and 11 of this paragraph in the form of an electronic message sent to the address provided by the Service Recipient upon conclusion of the contract for the provision of the Newsletter service.
§ 3 Complaints
The Service Recipient may lodge complaints relating to the provision of the Newsletter services by the Service Provider, for example:
in writing to: SZOPEX-Dutkiewicz sp. z o.o. sp.k. Complaints Department, ul. Hozjusza 1r, 11-041 Olsztyn (Polska);
in the form of an e-mail message to the e-mail address of the Customer Relations Department (indicated, for example, in the footer of each subpage of the Online Shop and in the preamble to the Terms and Conditions).
To submit the complaint mentioned in section. 1 above, it is recommended that the Service Recipient indicates: (1) the subject of the complaint, i.e. a description of the reason for the complaint, (2) the Service Recipient's contact details, and (3) the Service Provider's preferred form of response in a sustainable medium (e.g. e-mail, written form). The recommendations mentioned in the previous sentence are not a condition for submitting a complaint.
The Service Provider will respond to the complaint on a sustainable medium within 30 days from the date of receipt of the complaint (unless otherwise provided in specific regulations).
§ 4 Personal data
The administrator of the personal data of the Service Recipient processed within the Newsletter Service is the Service Provider.
The Service Recipient's personal data are processed for the purpose of providing the Newsletter service. The provision of personal data by the Service Recipient is voluntary, but necessary to provide the Newsletter service.
Detailed information on the protection of the Service Recipient's personal data is contained in the "Privacy Policy" tab available in the Online Shop.
With regard to data protection issues, the Service Recipient may directly contact the Service Provider's designated data protection inspector by sending a message to the e-mail address: [email protected].
§ 5 Modification of the Terms and Conditions
The Service Provider has the right to modify the Terms and Conditions for important reasons, including: modification of generally applicable legal provisions resulting in modification of the mutual rights and obligations of the parties to the Newsletter service provision agreement, modification of the method of service provision for technical or organizational reasons, modification of the scope of the service provided.
The Service Provider shall inform the Service Recipient of the changes to the Terms and Conditions by posting the new version of the Terms and Conditions in the "Terms and Conditions for the provision of the Newsletter service" tab available in the Online Shop and by sending an e-mail with information on the changes to the Terms and Conditions and the new version of the Terms and Conditions to the e-mail address indicated by the Service Provider.
The amendment to the Terms and Conditions shall enter into force 14 days after the date of notification of the amendment, in the manner indicated in paragraph. (2) above.
In accordance with § 2 para. 9 above, the Service Provider may terminate the contract for the provision of the Newsletter service at any time (including in the event of non-acceptance of the new Terms and Conditions).
§ 6 Final provisions
The Regulation shall enter into force on 17.12.2021.
The contract for the provision of the Newsletter service shall be concluded in Romanian.
The registration, securing and access to the important provisions of the Newsletter Service Agreement shall be carried out by sending a message to the Service Recipient at the indicated e-mail address.
These Terms and Conditions do not exclude or limit any rights of the Service Recipient (in particular of the Consumer), to which he is entitled under the legal provisions in force. Any provisions in these Terms and Conditions which are less favourable to the Service Recipient than the mandatory provisions of the law are void and are superseded by these provisions.
The Service Recipient may access the Terms and Conditions at any time via the "Terms and Conditions for the provision of the Newsletter service" tab available in the Online Shop, from where it may at any time: obtain, retrieve and print the contents of the Terms and Conditions. In addition, the Service Provider will make the content of the Terms and Conditions available for download in PDF format in the Online Shop.
The use of the Newsletter service involves typical risks related to the use of the Internet, for example, access to data by unauthorised persons, unauthorised distribution of data, the possibility of receiving spam, the possibility of being exposed to cracking ("security breach") or phishing ("password theft"). The service provider has implemented and uses appropriate technical and organisational measures to ensure an adequate level of security of the services provided.
In matters not covered by these Terms and Conditions, the relevant generally applicable legal provisions shall apply.
